What are the obligations of the EU Representative?

A manufacturer may, through a written mandate, appoint an authorised representative to act on their behalf. This representative is authorised to undertake specific tasks in accordance with the terms outlined in the mandate, providing an important function in ensuring product safety compliance.

The authorised representative must carry out the duties specified in the mandate provided by the manufacturer. Upon request, they are required to supply market surveillance authorities with a copy of the mandate. This ensures transparency and confirms the representative’s authority to perform their role effectively.

As part of their responsibilities, the authorised representative must provide the market surveillance authority, upon its reasoned request, with all relevant information and documentation that demonstrates the safety of the product. This must be presented in an official language that the authority can understand, ensuring clear communication and compliance.

If the authorised representative has reason to believe that a product is unsafe or potentially dangerous, they are obligated to inform the manufacturer of their concerns. This allows for timely action to be taken to address any potential safety risks and protect consumers from harm.

The authorised representative must also inform the competent national authorities about any actions taken to mitigate the risks associated with the products they are responsible for. This includes submitting notifications through the Safety Business Gateway when risks have not been addressed by the manufacturer or when instructed to do so by the manufacturer. Additionally, the representative must cooperate with national authorities to effectively manage any risks identified with the products under their mandate.
